1. Acceptance of Terms

If you do not agree to these terms, do not use this website or request services. These terms apply to all visitors, customers, and others who access the site or engage with our services.

2. Description of Services

Aliso Viejo Asphalt Paving provides asphalt paving, sealcoating, repair, and related services for residential and commercial properties in Aliso Viejo, CA and surrounding communities. The specific services to be performed on any project are described in a written estimate or contract provided to the customer before work begins.

We reserve the right to decline any project at our discretion. We do not guarantee availability on any specific date or within any specific timeframe until a written contract is signed and a start date is confirmed.

3. Estimates and Pricing

All estimates are provided free of charge and carry no obligation. An estimate is a good-faith assessment of the anticipated cost based on information available at the time of the site visit. Estimates are not binding contracts.

A written contract or work order specifying the agreed scope of work and total price must be signed before any work begins. The contract price is binding unless unforeseen conditions are discovered during the project - such as a deteriorated base, buried obstructions, or access limitations not apparent during the estimate visit. In such cases, we will notify you in writing before proceeding with any additional work.

Prices quoted in estimates are valid for 30 days from the date of the estimate, after which material and labor costs may require a revised quote.

4. Scheduling and Cancellation

Scheduled project dates are confirmed in writing when the contract is signed. We make every effort to begin work on the scheduled date, but may need to reschedule due to weather, equipment issues, or circumstances beyond our control. We will notify you as soon as possible in such cases.

If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice after a deposit has been paid may result in forfeiture of all or part of the deposit, depending on the costs already incurred.

We reserve the right to cancel a project without penalty if site conditions at the time of work are determined to be unsafe or unsuitable.

5. Payment Terms

Payment terms are specified in the written contract. A deposit may be required before work begins on larger projects. The remaining balance is due upon completion of the work, before the crew leaves the property, unless otherwise agreed in writing.

Accepted payment methods are specified in the contract. Checks returned for insufficient funds will incur a returned check fee of $35, plus any bank fees we incur. Balances not paid within 30 days of the due date may be subject to a late fee and may be referred to a collection agency.

We reserve the right to place a mechanic's lien on the property if payment is not received in accordance with the agreed terms, as permitted under California law.

6. Customer Responsibilities

You are responsible for:

• Ensuring the work area is clear of vehicles, personal property, and obstructions before the crew arrives
• Obtaining any required HOA approvals before work begins
• Notifying us of any underground utilities, irrigation lines, or other buried features near the work area
• Keeping children and pets away from the work area during and after the project until the surface is safe to use
• Following any post-installation care instructions provided by our crew

We are not responsible for damage to underground utilities or features that were not disclosed prior to work beginning.

7. Warranty and Workmanship

We stand behind our workmanship. The specific warranty terms for any project are stated in the written contract. In general, we will correct any defect in our workmanship at no charge during the warranty period, provided:

• The defect is due to our workmanship or materials, not external factors
• The surface has not been subjected to damage from tree roots, soil movement, vehicle damage, or other external causes
• Post-installation care instructions have been followed
• The warranty claim is made within the warranty period stated in the contract

Natural weathering, fading, and oxidation of asphalt surfaces over time are normal and are not covered under workmanship warranty. Regular maintenance, including sealcoating on the recommended schedule, is the customer's responsibility.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Aliso Viejo Asphalt Paving is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services, including but not limited to loss of income, loss of profits, loss of data, or property damage not directly caused by our negligence.

Our total liability for any claim arising from a specific project shall not exceed the total amount paid by you for that project.

9. Warranty Disclaimers

The information on this website is provided for general informational purposes only. It is not a substitute for professional assessment of your specific property and conditions. We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, or suitability of any information on the site.
